Senator Cynthia Lummis supports SCOTUS ruling limiting federal agency powers

U.S. Senator Cynthia Lummis (R-WY) released a statement following the U.S. Supreme Court's decision in the Loper Bright v. Raimondo case, which overturned the Chevron doctrine and limited federal agencies' authority.

"For far too long, the Chevron doctrine has empowered unelected and unaccountable federal bureaucrats to have virtually uninhibited power to interpret the law however they please and use that interpretation to cater to this administration’s far-left base," said Lummis. "For years, the people of Wyoming have been forced to endure the consequences of an unchecked Biden administration and its heavy-handed regulations, and they have had enough. I applaud the Supreme Court’s decision to restore decision-making power back to democratically-elected members of Congress just as our Founding Fathers intended rather than allowing D.C. bureaucrats to rule with an iron fist."

Last July, Senator Lummis joined 17 lawmakers in filing an amicus brief in the case of Loper Bright Enterprises v. Raimondo, arguing that "Chevron deference" violates Articles I, II, and III of the Constitution.

In January, Senator Lummis led her colleagues in filing an amicus brief in Garland v. Cargill before the U.S. Supreme Court. The brief asserted that the Biden administration’s Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) weaponized the Chevron doctrine to create new federal crimes without Congressional approval. Last week, the Supreme Court found that ATF's reversal on this question was illegal and that its rule was unenforceable.
